Key Terms and Conditions of Employment

The Federal Magistrates Court of Australia provides an attractive range of benefits for staff employed under the FMC Certified Agreement 2006-09. The following is a summary of the main features - you should refer to the agreement for the specific terms and conditions.

Remuneration

There is an annual general pay increase of 4.3% on 1 July 2008. In addition, staff participate in a performance management program where, provided performance is satisfactory, they can move incrementally within the salary range for their level or, if they are at the top increment for their level, they can receive a 3% bonus.
New staff are eligible to join the Public Sector Superannuation (PSS) Accumulation scheme. The FMC contributes 15.4% of salary to this scheme, which is 6.4% above the compulsory contribution level for most employers.

Leave

The key leave provisions are:

4 weeks annual recreation leave

the court closes in the period between Christmas and the end of the first week of the new year, and this is additional paid leave

3 months long service leave after 10 years service

up to 18 days leave is provided each year to deal with circumstances for staff:

who are ill or injured

to care for members of their family who are ill

as a result of special or exceptional circumstances

12 months maternity leave, of which 12 weeks is paid leave

Flexible working arrangements

The standard work day is 7 hours and 35 minutes

The Federal Magistrates Court of Australia provides a range of flexible working arrangements to encourage a work/life balance. These include:

the availability of flextime provisions for most staff (up to 40 hours can be accumulated), and time-in-lieu provisions for executive staff (up to 12 days per year where excess work hours are significant)

up to 4 weeks additional leave can be purchased by receiving a lower salary throughout the year

part-time work arrangements are available as either a permanent working arrangement or to meet a particular short term need

home based work where circumstances permit

Other benefits

There are a range of other benefits included in the certified agreement, including:

an employee assistance program providing access to confidential external counselling on personal or work problems

a health and well-being program for staff
