Family Law Fees

Cheques or Money orders for the payment of fees should be made payable to the Federal Circuit Court.

A number of fees apply to Federal Circuit Court proceedings pursuant to Schedule 1 of the Family Law (Fees) Regulation 2012.

Section 2.13 specifies a biennial increase in fees.

The fees listed below were effective from 1 January 2013.

$800 Application for divorce
$265*Application for divorce - Reduced fee
$500 Application for children and property
$305 Application (for children or property)
$305 Response, seeking different orders sought by applicant (for children or property)
$560 Setting down fee for hearing (defended matter)
$560 Daily Hearing Fee (for each hearing day, or part of a hearing day, excluding the first hearing day)
$105 Application for interim order
$50 Issuing a subpoena
$350 Conciliation conference
Nil Child Support Application/Response

* In some cases a reduced fee may be sought for a divorce application or in respect of other fees, an exemption, if you hold certain government concession cards or you can demonstrate financial hardship.
