When is this form used?

This form is approved for use for the purposes of Rule 15A.02 when a party requests the Court to issue, or the Court (or Registrar), of its own initiative, issues, a subpoena:

  • for production,
  • to give evidence, or
  • for production and to give evidence.

General information

Attached to the form are notes that will help you to complete the form and advise you what you need to do with the form.

A subpoena must specify the name or designation by office or position of the person to whom it is directed.

A subpoena requiring a person to produce a document or thing must include an adequate description of the document or thing.

A party should not request the issue of a subpoena for production and to give evidence if production would be sufficient in the circumstances.

A party cannot request the issue of more than 5 subpoenas in a case without permission from the Court.

The ‘Notice of Objection – Subpoena’ form that is attached to the back of the subpoena form is for use by:

  • a subpoenaed person when they want to object to production of documents set out in the subpoena, or
  • a person receiving a copy of the subpoena when they want to object to the inspection and/or copying of subpoenaed documents.

When serving the subpoena, both on the person subpoenaed, and on other parties and interested persons, you should provide those persons with a copy of Information for persons served with a subpoena or copy of a subpoena .

If you are requesting the issue of a subpoena for production of documents alone, you will also need to complete the Notice of request to inspect in accordance with FCC Rule 15A.13(1)(c) below.

When is this form used?

This form is approved for use for the purposes of Rule 15A.13(1)(c) for the purposes of notifying the Court that all parties and interested persons have been properly served with a copy of the subpoena.

The form must be completed by a party who has issued a subpoena to produce documents alone, as soon as practicable after the date for production of documents has passed. The subpoenaed documents will not be made available for inspection and/or copying until this form has been filed.
