When is this form used?

This form is approved for use when a party seeks to discontinue an application or response (see Subrule 13.01) or an application for divorce (see Subrule 25.17(3)).

General information

A notice of discontinuance may be filed:

- 14 days before the final hearing date,
- with leave of the Court if less than 14 days before the final hearing date.

Note leave is required to discontinue in some instances; see Subrule 13.01(3) and Subrule 25.17(1).
